# Terms of Use

These Terms of Use ("Terms") govern your use of the Crew Sleep mobile application (displayed in-app as "Cabin Crew Breaks") and related services (collectively, the "App").

 

By downloading, installing, or using the App, you agree to these Terms.

## 1. Eligibility and Acceptance

 

You must comply with applicable laws and App Store requirements when using the App.

 

If required by your jurisdiction, you represent that you are old enough to enter into these Terms, or that you are using the App with required parent/guardian authorization.

 

## 2. License Grant

 

Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on compatible devices you control.

 

You may not:

- reverse engineer, decompile, disassemble, or attempt to derive source code except where law expressly permits

- bypass subscription checks, feature gates, or security controls

- use the App in a way that violates law or third-party rights

 

## 3. Subscriptions, Billing, and Trials

 

Certain features require a paid subscription.

 

### 3.1 Billing channel

 

Subscriptions are sold through Apple In-App Purchase and billed to your Apple ID account.

 

### 3.2 Auto-renewal terms

 

Unless canceled at least 24 hours before the end of the current period, subscriptions automatically renew. Your account may be charged for renewal within 24 hours before the current period ends, under Apple's billing rules.

 

### 3.3 Pricing and storefront terms

 

Price, currency, taxes, billing cadence, and any trial eligibility are determined by Apple for your storefront and may vary by region.

 

### 3.4 Managing and canceling

 

You can manage or cancel subscriptions in Apple account subscription settings.

 

### 3.5 Refunds

 

Refunds are handled by Apple under Apple policies and applicable local law.

 

### 3.6 Trial conversion

 

If a free trial is offered, any unused trial portion may be forfeited when you purchase a subscription, as permitted by law and Apple's rules.

 

## 4. App Availability and Changes

 

We may add, change, suspend, or remove features (including paid features) to maintain security, reliability, legal compliance, or product quality.

 

Where required by law, we will provide notice of material changes.

 

## 5. Privacy

 

Your use of the App is also governed by the Privacy Policy:

Third-party platforms and processors (including Apple and RevenueCat) process data under their own terms and policies.

 

## 6. Important Use Limitations

 

The App is a planning and assistance tool only.

 

You remain solely responsible for:

- operational, regulatory, and employer-policy compliance

- safety-critical decisions

- verifying schedule outputs before relying on them

 

Notifications and alarms are reminders only and must not be treated as a sole safety or duty-control mechanism.

 

## 7. User Responsibilities

 

You are responsible for:

- maintaining security of your device and Apple account

- using the App lawfully

- ensuring data you enter is accurate enough for your intended use

 

## 8. Intellectual Property

 

The App, including software, design, text, graphics, branding, and related materials, is protected by intellectual property laws. All rights not expressly granted are reserved.

 

## 9. Disclaimer of Warranties

 

To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

 

We do not warrant uninterrupted, error-free, or completely secure operation.

 

## 10. Limitation of Liability

 

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, or business interruption.

 

If liability cannot be excluded under applicable law, total liability is limited to the amount you paid (if any) for the App subscription during the 12 months before the event giving rise to the claim.

 

## 11. Indemnity

 

To the extent permitted by law, you agree to indemnify and hold harmless the operator from claims, losses, liabilities, and costs arising from your misuse of the App, breach of these Terms, or violation of law.

 

## 12. Suspension and Termination

 

We may suspend or terminate access to all or part of the App if reasonably necessary for legal compliance, security, abuse prevention, or material breach of these Terms.

 

You may stop using the App at any time and may cancel subscriptions through Apple settings.

 

## 13. Governing Law and Disputes

 

These Terms are governed by the laws of the jurisdiction where the operator is established, unless mandatory consumer laws in your jurisdiction apply.

 

Disputes will be handled by competent courts in that jurisdiction unless mandatory law requires otherwise.

 

## 14. Regional Consumer Rights and Mandatory Law

 

Nothing in these Terms limits or excludes rights that cannot be waived under applicable law.

 

This includes, where applicable:

- California consumer protections and privacy rights under applicable state law

- EU/EEA/UK/Swiss consumer and data protection rights

- Any other mandatory statutory rights in your place of residence

 

If a provision in these Terms conflicts with mandatory law, mandatory law controls only to the extent of that conflict.

 

The warranty disclaimers, liability limitations, and indemnity terms apply only to the maximum extent permitted by applicable law.

 

## 15. Severability and No Waiver

 

If any provision is held unenforceable, remaining provisions stay in effect. Failure to enforce a provision is not a waiver of rights.

 

## 16. Apple Terms and EULA Priority

 

Where required by Apple's App Store terms, Apple may be a third-party beneficiary of these Terms.

 

If the Apple Licensed Application End User License Agreement (Standard EULA) applies via your App Store listing, and there is a direct conflict, the Apple-required terms govern only to the extent of that conflict.

 

## 17. Changes to These Terms

 

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and provide notice where required by law.
